ECPAT Austria was founded in November as a specialized body working against any form of sexual exploitation of children. Since December ECPAT Austria is a non-profit association and carries out campaigns and projects in cooperation with governmental and non-governmental organizations as well as network partners to raise public awareness, develop preventive measures, and create legal bases for the protection of children.
Contact: Ms. Austria has a solid legal framework, as far as Civil and Penal Law is concerned, aiming at protecting children from violence and abuse. Initiated by and in cooperation with ECPAT Austria, numerous measures for awareness raising and educational purposes have been implemented, especially on topics of Safeguarding, child trafficking, and sexual exploitation of children in travel and tourism. Austria is a destination and transit country for children trafficked for sexual purposes and criminal activities.
Most of the victims are Eastern or SoutheasternEuropean. The age of sexual consent is 14 years for both girls and boys. The national legislation provides for a three years close-in-age exemption. Active and passive extraterritoriality is provided for all SEC-related offences covered by the legislation of Austria under Section Double criminality is not required.
SEC-related offences can be extraditable if they are punished with at least one year of imprisonment under Austrian law including child trafficking, serious sexual abuse of minors and potentially other SEC offences and fulfil the double criminality requirement under Section 11 of the Federal Law on Extradition. SEC offences are referred to as extraditable under the European Arrest Warrant EAW framework without requiring double criminality within the EU if the act is punishable by a maximum period of at least three years of imprisonment in the requesting State.
